BLINKLEARNING S.L. works to offer you the best possible experience through our products and services. In some cases, data collection is necessary to achieve this. We care about your privacy and we believe in being transparent.

Therefore, and for the purposes of the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 (hereinafter "GDPR") on the protection of natural persons, to the Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights with regard to the processing of personal data, and the free movement of such data, and the Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce (hereinafter, "LSSI"), BLINKLEARNING S. L. informs the user that, as the data controller, it will incorporate the personal data provided by users in an automated file.

The first step in our commitment is to explain the following to our users:

What personal data do we collect?

The personal data that the user may provide:

  • Name and surname.

  • E-mail

  • Age

  • Any other information or data you choose to share with us.

In some cases, filling in the registration form is a compulsory requirement in order to access and enjoy certain services offered on the website; likewise, failure to provide the personal data requested or to accept this data protection policy will make it impossible to subscribe, register or participate in any of the promotions in which personal data are requested.

Why and for what purpose do we process your data?

BLINKLEARNING S.L.  processes the information provided by the interested parties for the following purposes:

  • Managing our online services.

  • Web users management.

  • Overseeing the delivery of requested information.

Personal data obtained as a result of your registration as a user will form part of the Record of Processing Activities and Operations (RAT), which will be updated periodically in accordance with the provisions of the GDPR.

What is the legitimate basis for the processing of your data?

How long do we keep your data for?

Data processing for the purposes described above will be stored for the time necessary to fulfil the purpose for which it was collected, as well as to comply with the legal obligations deriving from such data processing.

No data will be passed on to third parties

BLINKLEARNING S.L. has adequate measures in place to protect your personal data. These third parties are obliged to ensure that the information is processed in accordance with data privacy regulations.

Where is the data stored?

BLINKLEARNING S.L. shares your personal data outside the European Economic Area with Amazon Web Services exclusively for data storage purposes. We are obliged to ensure that any personal data processed by us or by our suppliers and partners operating outside the EEA is treated securely and protected against unauthorised access, loss or destruction, unlawful processing and any processing that is inconsistent with the purposes set out in this Policy.

BLINKLEARNING S.L. guarantees that no data is stored, shared or collected from Google users during the use of the Google API, except for the following: OAuth authentication token, Google user ID and e-mail, ID of the teacher's folders in Google Drive, the teacher's classes in Google Classroom, the profile picture and the email address of the users in the class. The data is only shown to the user through synchronisation with Google and is never stored on our servers, with the exception of those mentioned above.

BLINKLEARNING S.L. guarantees that during the use of the Microsoft API no Microsoft user data is stored, shared or collected, with the exception of the OAuth authentication token, the Microsoft user ID and associated e-mail, as well as the ID of the teacher's OneDrive folders. The data is only shown to the user through synchronisation with Microsoft and is never stored on our servers, except for the data listed above.

What are your rights and how can you exercise them?

You can direct any communications and exercise your rights by sending a request to the following e-mail address contact@blinklearning.com.

Pursuant to the provisions of the GDPR you may request:

  • Right of access: you may request information about the personal data we hold about you.

  • Right to rectification: you can communicate any change in your personal data.

  • Right to erasure and the right to be forgotten: you can request the deletion of your personal data after it has been blocked.

  • Right to restrict processing: this means limiting the processing of personal data.

  • Right to object: you can withdraw your consent to the processing of your data by objecting to further processing.

  • Right to data portability: in some cases, you can request a copy of personal data in a structured, commonly used and machine-readable format for transmission to another data controller.

  • Right not to be subject to automated individual decision-making: you can request not to be subject to decisions based solely on automated processing, including profiling, which produce legal effects or significantly affect the data subject.

In some cases, your request may be rejected if it requires the deletion of data necessary for the fulfilment of legal obligations.

In addition, if you have a complaint about the processing of your data, you can lodge a complaint with the data protection authority.

Who is responsible for the accuracy and truthfulness of the data provided?

The user is solely responsible for the accuracy and truthfulness of the data included, exonerating BLINKLEARNING S.L. from any liability in this regard. In all cases, users guarantee and are responsible for the accuracy, validity and authenticity of the personal data provided and undertake to keep them duly updated.

BLINKLEARNING S.L. is not responsible for the accuracy of the information that is not of its own elaboration and of which another source is indicated, so it does not assume any responsibility for hypothetical damages that may arise from the use of such information.

BLINKLEARNING S.L. reserves the right to update, modify or delete the information contained on its Website, and may even limit or deny access to such information. BLINKLEARNING S.L. is not responsible for any damage that the user may suffer as a consequence of errors, defects or omissions in the information provided by BLINKLEARNING S.L., whenever such information comes from external sources.

How do we process the personal data of minors?

In accordance with article 8 of the GDPR and article 7 of the LO3/2018, of December (LOPDGDD), BLINKLEARNING S.L. will require the valid, free, unequivocal, specific and informed consent of their legal guardians in order to process the personal data of minors. In this case, an ID card or other form of identification of the person giving consent shall be required.

In the case of persons over fourteen years of age, data may be processed with the consent of the user, except in those cases in which the law requires the assistance of those with parental authority or guardianship.

What security measures do we apply to protect your personal data?

BLINKLEARNING S.L. has adopted the legally required levels of security for the protection of personal data and endeavours to install those additional technical means and measures within its reach to avoid the loss, misuse, alteration, unauthorised access and theft of personal data provided to BLINKLEARNING S.L.

BLINKLEARNING S.L. is not responsible for hypothetical damages that may arise from interferences, omissions, interruptions, computer viruses, telephone breakdowns or disconnections in the operational functioning of this electronic system, caused by reasons beyond the control of BLINKLEARNING S. L. or for delays or blockages in the use of this electronic system caused by deficiencies or overloads of telephone lines or overloads in the Data Processing Centre, in the Internet system or in other electronic systems, as well as damage that may be caused by third parties through illegitimate intromissions beyond the control of BLINKLEARNING S.L. The user must be aware that security measures on the Internet are not impregnable.
